Provocation as a defense for assault or murder

What a fucking nonsense !  Today we have the man who murdered a gay guy getting off with a light sentence on the basis that he was "provoked" by the advances of the victim.  SO wrong ! 

We currently have the absurd game being played out in our courts at great expense and total waste of time with the Sophie Elliott case where the guy who has reportedly admitted murdering her in a particularly vicious manner playing out a nonsense in court justifying why his upbringing & events between them "provoked" him.

Every day the courts are littered with domestic & public violence cases where lame "provocation" defences are common place.

Time we grew up as a nation and changed our attitude & social values let alone the law to reflect that PROVOCATION IS NOT AN EXCUSE FOR VIOLENCE AS A MEANS OF RESOLVING A CONFRONTATION !!!

Unfortunately it's a Labour MP putting the submission together so as usual the integrity of the political system will be challenged.

As a footnote another sad aspect of that particular piece of legislation is apparently that historically its most common use was as a defence for murder when adultery was the "provocation"

This would be the equivalent of the French "crime of passion" law / defence yes? I can't believe that this is accepted as a defence, receiving a lighter sentence.

Going way back my mother was friends with someone who was murdered by her ex-husband at her work place. He didn't serve a whole lot of time - around 8 years I think.

Our whole legal system is fucked, has been since the loony left got hold of it. And even more so when you get crazies like Comrade Keith Locke, running around saying the Police should not have Tasers.

We have a system that also rewards crimes,  if they break out of jail, bust there arm and they get ACC.

We also have a Appeals court, who actually reduces sentences, that scum who kill that deaf girl is a classic example.

Until we as a society, stop excepting these idiots who make these laws, then it will continue.
